Welcome to TrufflePops. These Terms & Conditions (the “Terms”) govern your access to and use of the TrufflePops mobile app, websites, and related services (together, the “Service”). By using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.
1. Who we are
The Service is operated by TrufflePops (“TrufflePops”, “we”, “us”, or “our”). You can reach us any time through our contact page.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Service. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian.
3. Your account
Some features can be used without an account. Where you do create an account, you are responsible for keeping your login details secure and for all activity that happens under your account. Let us know promptly if you believe your account has been used without your permission.
4. Using the Service
TrufflePops is a habit and goal tracker. When using it, you agree not to:
- break any applicable law, or infringe anyone else’s rights;
- access, tamper with, or use non-public areas of the Service or our systems;
- probe, scan, or test the vulnerability of the Service, or defeat any security or authentication measures;
- interfere with or disrupt the Service, for example by sending automated or excessive requests;
- use the Service to send spam, malware, or otherwise harmful or unlawful content;
- harass, bully, threaten, impersonate, or otherwise harm other users, or collect their information without consent.
5. Your content
You keep ownership of the goals, notes, and other content you add to TrufflePops (“Your Content”). You grant us a limited licence to host, store, and display Your Content solely to operate and improve the Service for you. You are responsible for Your Content and for making sure you have the rights to share it.
6. Connecting with others
TrufflePops lets you connect with other people — for example by adding buddies, sharing goals, and sending or accepting invitations. Anything you choose to share with another user may be seen by them. You are responsible for how you interact with others, and we are not responsible for the conduct, content, or interactions of other users. We may remove content, or limit or end access, where we reasonably believe it is necessary to protect our users or the Service. We encourage you to report behaviour that breaches these Terms through our contact page.
7. Privacy
Your privacy matters to us. Our Privacy Policy explains what information we collect, how we use it, and the choices you have. By using the Service, you agree to our handling of information as described in the Privacy Policy, which forms part of these Terms.
8. Our intellectual property
The Service itself — including its software, design, companions, logos, and branding — belongs to TrufflePops and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial use, subject to these Terms.
9. Companions and virtual items
The Service may let you collect, earn, or unlock companions and other virtual items. These items are licensed to you for use within the Service, not sold or owned by you. They have no monetary value, cannot be redeemed for cash, and cannot be sold, transferred, or exchanged outside the Service. We may change, limit, or remove virtual items at any time, and they may be lost if your account is closed.
10. Subscriptions and payments
TrufflePops is free to start. If we offer paid features, the price, billing period, and renewal terms will be shown to you before you purchase, and any purchase made through an app store is also subject to that store’s terms. Except where required by law, payments are non-refundable. We may change our prices, and we may begin charging for features that were previously free. We will let you know before any such change takes effect, and for recurring subscriptions any price change will apply from your next renewal. If you don’t agree to a change, you can cancel before it takes effect.
11. Changes to the Service
We are always improving TrufflePops, so we may add, change, or remove features over time. This includes the appearance, design, and artwork of the app and its companions, which we may update, restyle, or replace at any time. We may also suspend or discontinue the Service, in whole or in part, where reasonable to do so.
12. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties about the Service and disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. TrufflePops supports habit building and is not a medical, psychological, financial, or other professional service.
Any information, suggestions, goals, or content in the Service are provided for general informational purposes only and are not professional, medical, health, fitness, psychological, or financial advice. You should seek advice from a qualified professional before starting any new activity, exercise, or routine. You use the Service, and act on anything within it, at your own risk, and to the fullest extent permitted by law we are not responsible for any injury, loss, or harm resulting from your use of the Service or reliance on its content.
13. Limitation of liability
To the fullest extent permitted by law, TrufflePops will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill arising from your use of the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including consumer-law guarantees.
14. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless TrufflePops and its team from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to Your Content, your use or misuse of the Service, your interactions with other users, or your breach of these Terms or of anyone else’s rights.
15. Feedback
If you send us ideas, suggestions, or other feedback about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use it for any purpose without any obligation or compensation to you. You don’t have to send us feedback, but if you do, we may act on it freely.
16. Termination
You may stop using the Service at any time. We may suspend, restrict, or end your access — and disable or remove your account — if you breach these Terms, use the Service in a way it isn’t intended to be used, or if we reasonably need to in order to protect the Service or other users. Provisions that by their nature should survive termination will continue to apply.
17. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we’ll take reasonable steps to let you know, such as by updating the date above or notifying you in the app. By continuing to use the Service after changes take effect, you accept the updated Terms.
18. General
These Terms, together with our Privacy Policy, are the entire agreement between you and TrufflePops about the Service and replace any earlier agreements. If any part of these Terms is found to be unenforceable, the rest will remain in full effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not transfer or assign these Terms, but we may transfer or assign them, for example as part of a merger, acquisition, or sale of assets. We are not liable for any delay or failure to perform caused by events beyond our reasonable control.
19. Governing law
These Terms are governed by the laws of Australia, without regard to conflict-of-laws principles, and you agree to the non-exclusive jurisdiction of the courts located there. You may also have rights under the laws of your own country that these Terms do not affect.
